This is an appeal from a judgment refusing to admit to probate a document purporting to be the will of Matthew Presho, deceased, and a codicil thereto. The judgment was entered pursuant to a verdict finding on six special issues in favor of the contestant, Laura C. Presho. Matthew Presho died in the county of Santa Clara on April 20, 1923, being about seventy-three years of age, and leaving an estate of approximately $40,000.
