— The appellants, Frederick G. and Eliza J. Eberwine, filed in the circuit court a motion for the release of said Eliza from a recognizance of replevin bail, alleging that on the 19th day of December, 1876, in a proceeding for bastardy in said court, the appellee recovered a judgment against Allen D. Eberwine for five hundred dollars, payable in specified instalments, and on the same day the said Eliza and one Matilda A. Daniel jointly and severally entered into a recognizance of replevin bail for the stay of execution on the judgment and for the payment thereof; that an execution had been…
