MEMORANDUM OPINION AND ORDER

INTRODUCTION

This action arises out of a debt-collection letter received by Plaintiffs Reginald D. Owens and Carolyn D. Owens from a law firm, Defendant Hellmuth & Johnson, PLLC (“H & J”), in December 2006. Plaintiffs allege that the letter violated the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq. (the “FDCPA”). H & J now moves to dismiss, arguing that the letter did not contravene the statute; Plaintiffs argue the opposite and seek summary judgment as to liability.
