HOUSER, J., pro tem.

Jack Ferdinand, John Sears, and John Geregae were convicted of the crime of murder in the first degree and adjudged to suffer the penalty of death. From such judgment and from an order denying their motion for a new trial they appeal to this court.

The evidence tends to show, in brief, that at about 12 o’clock at night a party consisting of four persons were seated in a stationary automobile which will hereafter be called automobile No. 1.
