— Appeal by defendant from a judgment of the Supreme Court, Queens County (Beldock, J.), rendered October 21, 1980, convicting him of criminal sale of a controlled substance in the second degree and criminal sale of a controlled substance in the third degree (two counts), upon a jury verdict, and imposing sentence.

Judgment reversed, on the law, and matter remitted to the Supreme Court, Queens County, for further proceedings consistent herewith. No questions of fact have been raised or considered.
