Defendant was indicted and charged with the crimes of burglary in the second degree and burglary in the third degree. His implication in the crimes was based solely upon circumstantial evidence. Late on the night of December 6, 1984, State Police officers responded to a call regarding a burglary at Robert Belvin’s residence in St. Lawrence County.
