The Court has before it Defendant’s Motion for Summary Judgment and Brief in Support Thereof (Docket No. 32) and Plaintiffs Initial Reply to and Opposition to Motion for Summary Judgment and Request for Time to Take Depositions and File Final Reply (Docket No. 35).
