FLAUM, Circuit Judge.
Jan Kubon, a citizen of Poland, appeals from a decision of the Board of Immigration Appeals (BIA) that upheld an immigration judge’s order finding him deportable and denying his applications for asylum and withholding of deportation pursuant to sections 208(a) and 243(h) of the Immigration and Naturalization Act, 8 U.S.C. §§ 1158(a) and 1253(h). The BIA determined that Kubon failed to establish his eligibility for asylum on the basis of either past persecution or a “well-founded fear” of persecution. See INS v.
