GARWOOD, Circuit Judge:
The Immigration and Naturalization Service (INS) initiated deportation proceedings against Mamdouh Abdel-Masieh (Abdel) on December 4, 1990. The immigration judge found Abdel to be ineligible for asylum and for withholding of deportation under the Immigration and Nationality Act. The Board of Immigration Appeals (BIA) affirmed the immigration judge’s decision and dismissed Ab-del’s appeal. Abdel brings this petition to review the final order of deportation pursuant to 8 U.S.C. § 1105a(a). We vacate the order of deportation and remand to the BIA.
