OPINION
ENSLEN, District Judge.
Defendants, the Michigan Department of Natural Resources (“DNR”) and David F. Hales, the Director of the DNR, have filed both a motion for summary judgment and a motion for partial dismissal in this case.
Facts
The plaintiffs are a group of commercial fishers whose state-issued commercial fishing licenses have been drastically impaired by reductions in the commercial harvest occasioned by the entry of a consent order in United States v.
