MEMORANDUM OPINION

Plaintiff, Barbara Felder (“Plaintiff’) filed the Complaint in this action as Personal Representative of the Estate of her late husband, Marvin Felder (“Felder”), 1 against Defendant Mike Johanns, in his official capacity as Secretary of the United States Department of Agriculture (“USDA” or “the Agency”).
