On rehearing we have modified certain statements of facts contained in our former opinion. Otherwise we adopt that opinion as a correct determination of the issues presented, as follows:

Charles Hansen offered for probate the alleged last will of his brother Peter Hansen, deceased, dated November 26, 1936, by the terms of which the proponent was made sole devisee and executor of the estate. The will was contested by Carl' Thomsen, an intimate friend and benefactor of the deceased, with whom he had lived for twenty years.
