This is an appeal from a judgment of $3,500 recovered by appellee for injuries sustained by him while working in appellant’s coal’ mine.

Appellant operates its mine and removes coal therefrom by means of cars running on an incline, which extends from the surface of the ground to where the coal is mined. The incline is equipped with a double track and endless cable, by means of which loaded cars are drawn up one track and empty ones let down the other.
