OPINION

SMITH, Chief Judge.

This matter is before the court on defendant’s motion to dismiss pursuant to 12(b)(1) of the Rules of the United States Court of Federal Claims (RCFC) for lack of subject matter jurisdiction and RCFC 12(b)(4) for failure to state a claim for which relief can be granted. Plaintiff seeks $10,000,000 in damages for an alleged breach of contract arising from an oral promise made by the United States government.
