Defendant was charged by indictment with burglary in the first degree, robbery in the first degree and burglary in the second degree. After a jury trial, defendant was convicted of the lesser included offense of robbery in the second degree and thereafter sentenced to nine years in prison followed by five *1145years postrelease supervision. Defendant now appeals, contending initially that the evidence against him should have been suppressed because the police command for him to stop upon their first encounter as he and a companion were descending the back stairs of an apartment building…
