This appear involves two questions: (1) The right to a change of judge, and (2) the right to a continuance of the cause.

The facts are recited in detail in the journal entry of judgment, from which we find that the case was called on the trial docket of the district court of OMahoma county, Okla., on December 9, 1930, before Judge Lucius Babcock. A verbal motion for a continuance was overruled and an affidavit was then presented, urging the disqualification of Judge Babcock by reason of bias. This was sustained by Judge Babcock, and Judge W.
