TJOFLAT, Circuit Judge:

This is a qui tam action brought in the United States District Court for the Northern District of Alabama by a physician, the relator, against two physicians and several health care providers under the False Claims Act, 31 U.S.C. § 3729, et seq. The district court dismissed the relator’s complaint, and he now appeals. The questions lying at the heart of this appeal are whether the complaint’s allegations of fraud have been made with the “particularity” required by Federal Rule of Civil Procedure 9(b) and, if not, whether the district court abused its discretion in not…
