Plaintiff, an employee of the defendant Utah Apex Mining Company, within the provisions of the Utah Industrial Act (Comp. Laws 1917, §§ 3061-3165, as amended), on January 19, 1925, was injured as the result of an accident in the course of his employment. He was paid by the defendant iEtna Life Insurance Company, the insurance carrier, the sum of $16 per week, until April 6, 1925, at which time the company ceased payments, claiming that plaintiff was able to resume work, and that he was not permanently injured.
