FUTEY, Judge.
This Wmsiar-related case is before the court on defendant’s motion for summary judgment on damages and plaintiffs cross-motion for partial summary judgment. Defendant maintains that plaintiffs reliance and restitution claims are based on net liabilities assumed and, therefore, precluded by precedent of the United States Court of Appeals for the Federal Circuit (Federal Circuit).
