Reversing.

Charles Clary was indicted in the Daviess Circuit Court charged with the crime of embezzlement, as denounced by Section 1202 of the Kentucky Statutes. Upon his trial under this indictment he entered a plea of not guilty, and was found guilty by the jury, and sentenced to imprisonment for an indeterminate period of not less than one year nor more than two years, and judgment was pronounced upon the verdict by the court in accordance with it.
