delivered the Opinion: of the Court.

In this action defendant Albert H. Uithof secured a jury verdict in his favor after a nine day trial arising from an automobile accident which occurred in Glacier County. Subsequently the district court of Glacier County granted plain tiffs a new trial. From this order granting a new trial, defendant appeals.
