This is an appeal from an order granting a new trial following entry of judgment upon a jury verdict in the district court of Broadwater County.

The case involves an automobile collision near the T-intersection of the “Hassel Road” with U.S. Highway 287 about one mile north of Townsend, Montana, which occurred at about 8:00 p.m. on September 18, 1959.
