PRENDERGAST, Presiding Judge.
Appellant was in dieted for the murder of Tom Tucker alleged to have occurred on December 19, 1912. He was indicted on April 24, 1913, at once arrested, and tried and con victed of manslaughter on May 24, 1913, and his punishment fixed at two years in the penitentiary,—the lowest prescribed,by law.
The evidence on the State’s side was amply sufficient to have sustained a verdict of murder in the first or second degree, but as appellant was convicted of manslaughter only, murder passed out of the case and it is unnecessary to recite the evidence or discuss anything…
