DAVIS, District Judge.

1. INTRODUCTION

Jurisdiction over this insurance coverage declaratory judgment action is based upon diversity of citizenship, 28 U.S.C. § 1332, and the parties agree that Maryland law is controlling. Plaintiff, Icarom, PLC, a corporation formed under the laws of the Republic of Ireland, sued Howard County, Maryland, seeking a declaration that, under insurance Policy No. PY 220684 (“the Policy”), it has no duty to indemnify Howard County against a pending lawsuit, or as to any other claims arising from the off-site migration of pollutants and hazardous substances…
