*2 MEMORANDUM AND ORDER
SULLIVAN, District Judge.
This matter is before the Court on the plaintiffs and the individual Parvizian defendants cross-motions for summary judgment pursuant to Fed.R.Civ.P. 56(c). Upon consideration of the pleadings and the arguments of counsel, the plaintiffs motion for summary judgment is GRANTED in part and DENIED in part and the motion for summary judgment of defendants, Abdolreza Parvizian, Abolghassem Parvizian, Giti Parvi-zian, Inger Parvizian, Manoucher Parvizian, Massud Parvizian, and Simin Parvizian is GRANTED.
