Presently before the Court is Defendant Maine Central Railroad Company’s (“Maine Central”) Motion for Summary Judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. Maine Central’s motion is in response to an action brought against it by Plaintiff Donald Moody under the Federal Employers Liability Act (“FELA”), 45 U.S.C. 51, et seq., alleging that the Plaintiff suffered injuries as a result of the negligent acts and omissions of the Defendant.
