Plaintiff Scottsdale Insurance Company (“Scottsdale”) brings this diversity action against defendant Indian Harbor Insurance Company (“Indian Harbor”). Scottsdale, the excess insurer to Cole Partners, Inc. (“Cole”), alleges that Indian Harbor, Cole’s primary insurer, acted in bad faith and with gross disregard to Scottsdale’s interests by failing to settle, for an amount within the $1 million primary insurance policy, a lawsuit brought by Linzy Dickson (“Dickson”).
