Lees, C.. On November 7, 1925, the summons in this action was delivered to If. L. Mundy at St. Paul, where he resides. At that time he was a director and a vice-president of the respondent, Shattuck-Denn Mining Corporation. The respondent appeared specially and moved that the service be vacated and set aside. An affidavit by one of respondent’s attorneys was presented in support of the motion.
