STATEMENT OF FACTS

The plaintiff in error, plaintiff in the court below, commenced this action to recover the sum of $3500.00, a balance due upon an executed contract for the furnishing of oil mill machinery. Said sum is admitted to be due the plaintiff, unless the defendant is entitled to recoup in damages for a breach of the contract in failing to deliver the machinery during the last days of July, 1902, and not until the 20th day of September, following.

The defendant by way of answer and cross-petition answered the petition of plaintiff as follows:
