Defendant was arrested for violating section 1025 (a) of the Vehicle Code of 1929 (P. L. 905) in failing to stop after being involved in an accident resulting in injury to person and damage to property; and was brought before R. L. R. Snyder, burgess of Shippenville Borough for a hearing. He waived a hearing and entered bail for his appearance at the next court of quarter sessions. After the transcript and recognizance were returned to the clerk of the court, but before indictment found, he moved the court of quarter sessions to quash the proceedings on the ground that…
