THOMPSON, J.

This is an appeal from a summary judgment against plaintiff longshoreman seeking damages for negligence of defendant shipping company, owner of the ship upon which he was working when injured. It involves the standard of negligence applicable to actions based upon the 1972 amendments to the Longshoremen’s and Harbor Workers’ Compensation Act. (33 U.S.C. §§ 903-905.) Concluding that the standard is one established by federal rather than state law but that defendant’s declarations do not rebut all the elements of liability under even the strict federal test of maritime…
