Certiorari has been granted to the Court of Appeals, oral argument has been heard and we now dispose of the case.

Thelma Day sued Frank Walton, John T. Dowell, Alvin Futrell, H. H. Thomas, Hartford Accident & Indemnity Company, Standard Accident Insurance Company and the Metropolitan Casualty Insurance Company, seeking to recover damages for personal injuries consisting of a pistol shot wound allegedly inflicted by the negligent firing of a pistol by defendant Frank Walton.
