MEMORANDUM
WARRINER, District Judge.
On 2 April 1979 this Court entered judgment pursuant to the mandate of the United States Court of Appeals for the Fourth Circuit in this matter. On 3 May 1979 the plaintiff moved the Court for an award of attorney’s fees pursuant to the Civil Rights Attorney’s Fees Awards Act of 1976, 42 U.S.C. § 1988. The Court was concerned that plaintiff’s motion was properly a motion to alter or amend a judgment under Fed.R.Civ.P. 59(e), which must be made within 10 days of the entry of judgment.
