Beside a stream in South Carolina stands one of the most remarkable white elephants in our American history, rich as it is in similar constructions. It is a plant which is completely useless but has absorbed, according to its owners, over $200,000,000 in their capital plus unstated amounts in public funds. The owners seek to shift their loss to the United States, making use of the consent granted in the Tucker Act, 28 U.S.C. § 1491, to sue the government for just compensation in instances of takings of property “for public use.” The Claims Court dismissed the…
