This case was referred pursuant to Rule 57(a) to Trial Commissioner Richard Arens, with directions to make findings of fact and recommendation for a conclusion of law. The commissioner has done so in an opinion and report filed on February 17, 1965. No exceptions or briefs have been filed by the parties and the time for plaintiff to so file expired April 5, 1965. On April 23, 1965, the defendant filed a motion for adoption of the commissioner’s opinion and findings of fact to which plaintiff has filed no response.
