This is an employee-removal case, in which both parties have moved for summary judgment, referred to trial commissioner Mastín G. White, pursuant to Rule 37 (e), for his recommendation for conclusion of law. The commissioner has submitted an opinion and a recommended conclusion. Plaintiff has sought review of that opinion and recommendation. Oral argument by counsel has been had, and the court has also considered the briefs filed by the parties.
