MEMORANDUM
HERBERT F. MURRAY, District Judge.
Plaintiff, Clifford Butler (“Butler”), a black male, brought the instant suit against defendant, Westinghouse Electric Corporation (“Westinghouse”), after Westinghouse fired him for allegedly sleeping on the job. In his complaint 1 , he alleges:
Count I: violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq., as amended 1972;
Count II: violation of 42 U.S.C. § 1981;
Count IV: breach of contract;
Count V: abusive discharge;
Count VI: intentional infliction of emotional distress; and
Count VIII: negligence.
