Appeal from a judgment of the superior court for Spokane county, Belt, J., entered March 7, 1904, upon the verdict of a jury rendered in favor of the plaintiffs, in an action for personal injuries sustained by reason of a defect in a bridge.

Action for personal injuries. The plaintiffs obtained a judgment in the court below, and defendant appeals. The respondent Mrs. Benson, while attempting to drive a horse and buggy upon a bridge maintained by the *102city of Spokane within its borders, was thrown from her buggy, and severely injured. The negligence complained of was, that the city had permitted the bridge to become and remain out of repair, so that the approach to the bridge contained a hole in the floor, eight or ten inches wide and four feet long; that, when she came up to the bridge, not knowing the condition thereof, and with…
