Appeal from a judgment of the superior court for Pierce county, Chapman, J., entered May 19, 1908, upon the verdict of a jury rendered in favor of the plaintiff, for personal injuries sustained in a fall upon a sidewalk.

— This is an action to recover for personal' injuries received by slipping and falling upon a sidewalk. The place of the accident was upon South Thirteenth street, in the city of Tacoma, where the grade of the street is at an incline down the hill from Commerce street to Pacific avenue. In the construction of the sidewalk, a coal hole was placed there for the use of the abutting owners, which was covered with a smooth piece of sheet steel or iron, lying at the same incline as the surface of the walk.
