An action was first instituted in the municipal court of tbe city of High Point by the Wolfe & Crane Company against the Carolina Transportation & Distributing Company and the American Alliance Insurance Company upon an insurance policy issued by said insurance company to cover tbe legal liability of said transportation and distributing company as a carrier for tbe loss of a shipment of rugs from Philadelphia, Pa., and Trenton, N.
