On February 23, 1978, appellant Roger L. Summer (referred to as “Summer” or “plaintiff” or “appellant”) filed this complaint in the United States District Court for the Southern District of Florida. Subject matter jurisdiction was predicated on alleged violations of the federal securities laws; however, several state law claims were also asserted under the district court’s pendent jurisdiction.
