This ease may well be doomed by the inability of the plaintiff to produce relevant documents. However, the time has not yet come for the axe to fall. The defendant, U.S. Bank National Association (“U.S. Bank”), has moved pursuant to Rule 37(b) of the Federal Rules of Civil Procedure to dismiss the action due to the failure of the plaintiff, Royal Park Investments SA/NV (“Royal Park”), to comply with a discovery order.
