This is the second time these parties have been before us on this case. See Keenan v. Donaldson, Lufkin & Jenrette, Inc., 529 F.3d 569 (5th Cir.2008) (reversing district court’s grant of summary judgment under the Louisiana Credit Agreement Statute) (hereinafter Keenan !)
