Defendant was indicted and charged with the crime of murder in the second degree in violation of Penal Law § 125.25 (1). Defense counsel has moved to suppress statements allegedly made by the defendant to an individual cooperating with New York State law enforcement officials while the defendant was incarcerated on unrelated charges in a Georgia correctional facility.
