This is an excess judgment case, that is, a complaint brought by an insured (in this case the trustee of the bankruptcy estate of the insured) against his insurance carrier for its failure tó settle a claim against the insured which resulted in a verdict and judgment far in excess of the insurance policy limits of liability ($10,000 insurance coverage, $120,000 judgment).
