We have here two matters that should be settled to wit: (1) When does the law allow a summary judgment, and (2) can mere opinion evidence ever warrant a summary judgment? The statute (Code Ann. § 81A-156 (c); Ga. L. 1966, pp. 609, 660; 1967, pp. 226, 238) states it is intended that summary judgment issue only when there is no issue of fact and the moving party is entitled to judgment as a matter of law.
