This action arises out of an application by the American Civil Liberties Union (“ACLU”) for permission to conduct a charitable raffle. The ACLU claims that the Rhode Island Lottery Commission (“Commission”) and its director, Peter J. O’Connell, unconstitutionally denied it a license. It seeks both damages and equitable relief for the violation of its federal constitutional rights to freedom of association, freedom of speech, substantive due process and the equal protection of the laws, under the First and Fourteenth Amendments.1 The ACLU also has alleged…
