This appeal presents questions concerning the propriety of the district court’s decision to dismiss an action brought by Ainsworth Aristocrat International Pty, Ltd. (“Ainsworth”) against the Tourism Company of the Commonwealth of Puerto Rico, Bally Manufacturing Company (“Bally”), and International Game Technology (“IGT”). The district court dismissed the action on two grounds: The Court concluded that the Puerto Rico Tourism Company, an indispensable party, was immune from suit in federal court under the Eleventh Amendment and that the plaintiff failed to…
