MEMORANDUM OPINION
PAUL L. FRIEDMAN, District Judge.
This employment discrimination matter is before the Court on defendant’s motion to dismiss the action pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure for failure to state a claim. Defendant Eric H. Holder, Jr., the Attorney General of the United States, filed the motion on March 14, 2012, approximately one year ago. See Defendant’s Motion to Dismiss (“Def.’s Mot.”), Dkt.
