Defendant appeals from a judgment of his conviction of the commission by him of the crime of grand theft; also from an order by which his motion for a new trial was denied.

Owing to the nature of the questions which are presented in appellant’s brief, it becomes necessary to set forth somewhat in detail the evidence upon which the judgment de- ' pended.
